1. Contract

a. Geoff Telford Photography (“Photographer”) hereby agrees to perform photographic services for the Wedding specified above in a professional manner. Geoff Telford Photography may employ one or more assistants (if required). Geoff Telford Photography is not responsible for the impact on the final product of any interference caused by guests or other vendors at the Wedding. Geoff Telford Photography will make every effort to obtain, but cannot guarantee delivery of, any specific images requested by client because of the lack of control over the Wedding, its participants, weather, and any rules or restrictions of the venue or official conducting the Wedding.

b. If Geoff Telford Photography is exposed to (i) unsafe conditions, or (ii) objectionable or illegal acts at the Wedding, Geoff Telford Photography reserves the right to take reasonable action to remedy such a situation, including but not limited to leaving the Wedding. In such event, Geoff Telford Photography shall not be obligated to refund any of the fees paid because of such action.

2. Retainer/Payment

A non-refundable Booking Fee of £500 (that shall be deducted from the total cost of all items agreed for your wedding) is due upon execution of this agreement, at which time Geoff Telford Photography commits to being available on the agreed date (subject to non-payment, reasonable emergencies and force majeure events, see Section 8). Remaining payments of the balance will be due in full 6 weeks before the agreed wedding date. In the event of no payment as specified, Geoff Telford Photography has the right to immediately terminate this Contract with no further obligation to refund money (including the aforementioned Booking Fee), to attend the Wedding or to supply images.

3. Copyright

a. All photographs taken by Geoff Telford Photography at the Wedding, in whatever form, are copyright protected. Geoff Telford Photography will allow reproduction and publishing for personal use (eg. wall hangings at home, Facebook, blogs), but any sale or publication for profit without Geoff Telford Photography’s express written permission is a violation of copyright law. Geoff Telford Photography retains Copyright in all images taken at the Wedding. This clause shall shall remain indefinitely.

b. Images (digital or printed) must not be supplied to third parties, this includes but is not limited to florists, car hire, makeup artists, dress suppliers etc. Please instruct them to contact Geoff Telford Photography directly if they wish to use images.

4. Wedding Changes

Geoff Telford Photography must be notified immediately of any changes in schedule or location, at least 28 days in advance of the scheduled wedding date. If Geoff Telford Photography is notified by phone, a written (i.e. email) confirmation must be sent within 2 days of such notification. If Geoff Telford Photography is not available on the ‘new date’, then Geoff Telford Photography shall be entitled to the Booking Fee amount (Section 2) as compensation (which may also be used for booking a new date, subject to Geoff Telford Photography’s availability).

5. Cancellation

Upon acceptance of these terms and payment of the Booking Fee, Geoff Telford Photography shall commit to attending the Wedding on the specified date, and shall make no other reservations for that date. If the wedding is cancelled for any reason, then Geoff Telford Photography shall not be required to repay any of the payments (including the Booking Fee) already made. If the Wedding is cancelled for any reason within 6 weeks of the agreed wedding date, the full balance is due to Geoff Telford Photography.

6. Price Protection

Geoff Telford Photography warrants all prices quoted for Wedding images are valid for a period of 6 months following the Wedding. Orders placed after such period are subject to Geoff Telford Photography’s published pricing at the time of the order placement. This includes, but is not limited to, prints, wall prints & albums.

7. Model Release

Geoff Telford Photography may reproduce, publish, exhibit, and otherwise use images from the Wedding for instructional or marketing purposes.

8. Force Majeure

If the wedding is not able to proceed on the agreed date (or the wedding is cancelled) due to fire, flood, casualty, strike, civil disturbance, war, terrorism or other acts of God (including a global pandemic such as COVID-19), then Geoff Telford Photography is not obliged to refund any monies already paid. A new date will be agreed subject to the availability of Geoff Telford Photography. If a suitable date cannot be agreed, the orginal Booking Retainer (Section 2) shall not be refunded. However, if Geoff Telford Photography cannot attend due to sickness, then another suitably skilled photographer will be offered.

9. Indemnification

Geoff Telford Photography may be limited by the guidelines or rules of the official performing the ceremony or the venue. Geoff Telford Photography will not be accountable for the impact that such restrictions may have on the final product e.g. restriction of photography during ceremony etc.

10. Limitation of Liability

Geoff Telford Photography’s entire liability for any claim, loss, damage, or injury arising under or relating to this agreement is limited to the fees paid for the services. In no event shall Geoff Telford Photography be liable for special, incidental, consequential, or punitive damages, even if client informs photographer of circumstances that would give rise to such damages.

11. Choice of Law

This Agreement shall be governed by the laws of the United Kingdom & Northern Ireland, notwithstanding its conflicts of laws provisions.

12. Waiver/Miscellaneous

This Agreement represents the complete and entire agreement of the parties with respect to the subject matter herein, notwithstanding any oral or written representations to the contrary made before, during, or after its execution. Any amendments to this Agreement shall only be effective if made in writing (email) that is executed by both parties hereto.

13. Protection of Deliverables/Retention of Files

Geoff Telford Photography shall take all reasonable steps to protect the images that are recorded at the Wedding until such time as the Album (or digital media) is delivered. Once the final product has been delivered, Geoff Telford Photography shall have no further obligation to preserve the images of the Wedding, regardless of the form of media in which they are stored.

14. Album Production

Production times may vary. Please allow up to 4 months from Proof Approval.

15. Album Ordering

Albums ordered more than 12 months after the wedding date will be subject to a £150 surcharge.
